Obtain­ing Licences for Busi­ness Activ­i­ties in Haz­ardous Waste Man­age­ment

The Insti­tute of Geol­o­gy pro­vides ser­vices for the prepa­ra­tion of doc­u­men­ta­tion and sup­port in obtain­ing licences for busi­ness activ­i­ties in haz­ardous waste man­age­ment. We analyse the com­pa­ny’s planned oper­a­tions, the list of haz­ardous waste, tech­no­log­i­cal process­es, mate­r­i­al and tech­ni­cal facil­i­ties, and exist­ing per­mits and reg­u­la­to­ry doc­u­men­ta­tion, and then pre­pare the doc­u­men­ta­tion pack­age required to obtain the licence.

The ser­vice cov­ers the entire process, from the ini­tial analy­sis of the com­pa­ny’s activ­i­ties and deter­mi­na­tion of the applic­a­ble licens­ing require­ments to the prepa­ra­tion of doc­u­ments and sup­port dur­ing their review by the licens­ing author­i­ty.

Licens­ing is car­ried out in accor­dance with the Law of Ukraine “On Waste Man­age­ment” and the Licens­ing Con­di­tions for Busi­ness Activ­i­ties in Haz­ardous Waste Man­age­ment, approved by Res­o­lu­tion No. 1278 of the Cab­i­net of Min­is­ters of Ukraine dat­ed 5 Decem­ber 2023.

Who Needs a Licence?

A licence is required for busi­ness enti­ties plan­ning to car­ry out busi­ness activ­i­ties in haz­ardous waste man­age­ment.

The licens­ing require­ment is deter­mined tak­ing into account the types of haz­ardous waste, planned oper­a­tions, tech­no­log­i­cal process­es, and spe­cif­ic facil­i­ties where the rel­e­vant activ­i­ties will be car­ried out.

What Do We Do to Obtain the Licence?

  • ver­i­fy waste codes and names in accor­dance with the Nation­al Waste List;
  • deter­mine the oper­a­tions to be car­ried out with haz­ardous waste;

Identification of Hazardous Waste

One of the key stages in prepar­ing for licens­ing is the cor­rect iden­ti­fi­ca­tion of haz­ardous waste involved in the com­pa­ny’s planned oper­a­tions.

Our spe­cial­ists iden­ti­fy and process infor­ma­tion on:
  • haz­ardous waste names and codes;
  • sources of waste gen­er­a­tion;
  • waste com­po­si­tion and haz­ardous prop­er­ties;
  • planned vol­umes of waste accep­tance and treat­ment;

Preparation of Documents for Obtaining a Licence

After analysing the source data, the Insti­tute of Geol­o­gy pre­pares a doc­u­men­ta­tion pack­age in accor­dance with the applic­a­ble Licens­ing Con­di­tions.

Depend­ing on the spe­cif­ic nature of the com­pa­ny’s activ­i­ties, the pack­age may include:

  • an appli­ca­tion for a licence;
  • infor­ma­tion on the loca­tions where the busi­ness activ­i­ties will be car­ried out;
  • a list of haz­ardous waste cov­ered by the planned activ­i­ties;
  • infor­ma­tion on haz­ardous waste man­age­ment oper­a­tions;
  • infor­ma­tion on the mate­r­i­al and tech­ni­cal facil­i­ties;
  • descrip­tions of equip­ment and tech­no­log­i­cal process­es;
  • organ­i­sa­tion­al and oth­er infor­ma­tion required by the Licens­ing Con­di­tions;
  • infor­ma­tion on exist­ing per­mits and oth­er reg­u­la­to­ry doc­u­men­ta­tion;
  • oth­er mate­ri­als depend­ing on the nature of the planned activ­i­ties.

Hazardous Waste Management Licence and Waste Treatment Permit

A licence for busi­ness activ­i­ties in haz­ardous waste man­age­ment and a per­mit for waste treat­ment oper­a­tions are sep­a­rate reg­u­la­to­ry doc­u­ments.

Depend­ing on the nature of the com­pa­ny’s activ­i­ties, law­ful haz­ardous waste oper­a­tions may require simul­ta­ne­ous com­pli­ance with both licens­ing and per­mit­ting require­ments.

The Insti­tute of Geol­o­gy can com­pre­hen­sive­ly analyse the com­pa­ny’s activ­i­ties and deter­mine the com­plete list of per­mits and oth­er reg­u­la­to­ry doc­u­ments required for their imple­men­ta­tion.

Expansion or Modification of Licensed Activities

If a com­pa­ny already holds a licence but plans to add new types of haz­ardous waste, intro­duce new oper­a­tions, or expand the scope of its activ­i­ties, it may be nec­es­sary to under­go the applic­a­ble pro­ce­dure for expand­ing the licensed busi­ness activ­i­ty.

Our spe­cial­ists analyse the planned changes, deter­mine the required doc­u­men­ta­tion, and pro­vide sup­port through­out the pro­ce­dure for mak­ing the rel­e­vant changes to the licensed activ­i­ties.
